Parties to the Contract

Between Namecare, registered in the Annecy Trade Register under number 422 424 697, located at Parc Altaïs, 12 Rue Véga, F-74650 Chavanod, and any person wishing to use the services offered by the website namecare.com, the following has been agreed:

Client’s Conditions

Only the General Terms and Conditions of Namecare are applicable to the contract concluded between it and the client. In the event that the client proposes divergent conditions, these are not binding on Namecare even if they have not been explicitly refused. The client’s conditions are nevertheless applicable to the contract if Namecare explicitly ratifies them in writing.

Content of Services and Remuneration

The content of the services offered as well as the amount of the corresponding remuneration and their method of payment result from the information contained on the website namecare.com, supplemented by the details relating to the object of the contract contained in the General Terms and Conditions.
The prices indicated by Namecare are final and exclusive of VAT (VAT not included).

Liability of Namecare

Namecare is only liable for damages resulting from intentional misconduct or gross negligence on its part or on the part of its legal representatives.

Protection of Computer Data

By entering into the contract, the client gives Namecare consent for any computer processing and recording of their data. The data will not be transmitted to third parties without authorization. The transmission of data concerning the client to a company entrusted by Namecare with a mission relating to the conclusion and execution of the contract is considered explicitly authorized. The client is informed that, given the current state of techniques relating to data transmission via the internet, it cannot be excluded that unauthorized third parties may access the data during transmission.

Applicable Law, Place of Performance, and Competent Court

The contractual relationship between the client and Namecare is subject to French law. The place of performance of the contract is Chavanod.

Individual Disputes and Contract Modifications

Modifications to contracts and disputes require written form to be valid, unless these General Terms and Conditions stipulate otherwise.

Modification of General Terms and Conditions

Any modifications to Namecare’s General Terms and Conditions will be communicated to the client by email within a maximum period of six weeks. The changes made will be accepted by the client if they do not express any opposition within a period of four weeks after becoming aware of the modifications, and will therefore become an integral part of the contract. Namecare undertakes to specifically inform the client of this legal consequence during each transmission of new General Terms and Conditions.

Ineffectiveness of a Contractual Stipulation

In the event of total or partial ineffectiveness (unenforceability, nullity) of a contractual stipulation or a clause of the General Terms and Conditions, the rest of the contract or the General Terms and Conditions remains valid. A condition corresponding to the purpose of the ineffective stipulation and respecting legal requirements will then be substituted. This provision also applies in the absence of regulation.
